Workplace sexual harassment remains a pervasive issue in the United States, with West Virginia leading the nation in claims filed with the Equal Employment Opportunity Commission (EEOC). According to a recent study by legal funding experts Mayfair Legal Funding, West Virginia had the highest rate of workplace sexual harassment charges per capita, with a staggering 5.12 charges filed per 100,000 residents between 2018 and 2021.

While West Virginia’s dominance in this dubious category might seem shocking, it’s not entirely surprising. The state’s history of coal mining and other male-dominated industries has long raised concerns about gender equality and workplace culture. And the COVID-19 pandemic, which forced many workers into isolation and closer proximity with their colleagues, may have exacerbated these issues.
Despite its alarming ranking, West Virginia has also seen a significant decrease in sexual harassment charges over the past few years. In 2018, there were 218 charges filed, but by 2021, that number had plummeted to just 40. This decline could be attributed to a number of factors, including increased awareness of sexual harassment, stronger workplace policies, and a willingness to report incidents.
However, it’s important to note that even with this decrease, West Virginia’s rate of sexual harassment charges remains far higher than the national average of 2.88 charges per 100,000 residents. And even a single instance of sexual harassment is one too many.
So, what can be done to address this issue in West Virginia? One key step is to ensure that all employees are aware of their rights and have access to resources to report harassment. Employers should also take proactive steps to create a work environment that is free from discrimination and harassment.
